Retrospective Planning

Retrospective planning is applying for planning permission after the building work has already been carried out. It is a popular choice amongst our clients as most organisations don’t want to miss the opportunity to start building as soon as possible.

It’s important to get retrospective planning right as your local authority may ask for all work to stop immediately and you may be asked to reconstruct any buildings that have been demolished.

The local council decides on applications in the same way as a regular planning application. Submitting a retrospective planning application after building work has already started will not affect the decision-making process, and you will not be penalised for doing so.

Starting the retrospective application process right away is always recommended. If you don’t, the council will send you a letter with a deadline to submit your retrospective planning application. If permission is granted, no enforcement action can or will be taken.

If your application is rejected, you must take immediate action. Unlike a standard planning application, you have different rights when appealing a refusal. If you don’t appeal quickly enough the council will take immediate enforcement action.
